PART 1: GENERAL TERMS AND CONDITIONS
1. INFORMATION ABOUT US
We operate the website www.quenchbar.co.uk (the “site”).We are Early Doors Bars Ltd t/as Quench Bar & Kitchen a company registered in England and Wales under company number 07951154 and with our registered office at Highland House, Albert Drive, Burgess Hill, West Sussex. RH15 9TN. Our VAT number is 133 0725 48.
2. CONTACTING US
2.1 You can contact us using any of the following methods: email us at askus@quenchbar.co.uk or contact the team by telephone on 01444 253332. Alternatively, you write to us at Quench Bar & Kitchen, 2-4 Church Road, Burgess Hill, West Sussex. RH15 9AE. If you use this method we will e-mail you to confirm we have received your letter.
2.2 If you are contacting us to cancel a Contract in accordance with your legal right to do so as set out in Clause 8, the easiest way to do this is to e-mail us at askus@quenchbar.co.uk. If you are emailing or writing, please include details of your order to help us to identify it. If you send your cancellation notice by e-mail or by post, then your cancellation is effective from the date you send the e-mail or post the letter.
2.3 If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.
3. HOW WE USE YOUR PERSONAL INFORMATION
We only use your personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you.
4. AGE REQUIREMENTS
4.1 You must be of the legal drinking age in your country, province or state of residence (18 years or older in the UK) to use this site and/or purchase Products.
4.2 We are not allowed by law to supply Products to you if you do not satisfy legal age requirements. If you are underage, please do not attempt to order these Products through our site and cease to use the site immediately.
5. OUR RIGHT TO VARY THESE TERMS
5.1 We amend these Terms from time to time and your continued use of the site following any changes shall be deemed to be your acceptance of such change. These terms were most recently updated on 20 November 2019.
5.2 Every time you order Products from us, the Terms in force at the time of your order will apply to the Contract between you and us. You should print a copy of these Terms or save them to your computer for future reference.
5.3 We may revise these Terms as they apply to your order from time to time to reflect changes in relevant laws and regulatory requirements. If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes. You may cancel either in respect of all the affected Products or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.
PART 2: TERMS AND CONDITIONS RELATING TO THE SALE OF PRODUCTS
This section of the Terms will apply to any contract between us for the sale of Products to you ("Contract"). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site.
These Terms apply to you as a consumer, which is a private individual purchasing goods from us. They do not apply if you are acting as a trade customer.
6. OUR PRODUCTS
6.1 The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from those images.
6.2 Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions and measurements indicated on our site have a 2% tolerance.
6.3 The packaging of the Products may vary from that shown on images on our site.
6.4 We reserve the right to change or withdraw products offered by us and that are displayed on our site without notice.
7. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
7.1 Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
7.2 After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in Clause 7.3.
7.3 We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched ("Your Product Has Been Shipped"). The Contract between us will only be formed when we send you the Shipped Confirmation. You are entitled to amend your order after it has been placed but before the Shipped Confirmation is sent. If you wish to amend your order, please e-mail askus@quenchbar.co.uk
7.4 If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site as referred to in Clause 12.5, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we shall offer you an alternative of equal or greater value, cancel the Product and refund you or we will refund you the full amount of the order including any delivery costs charged as soon as possible.
8. DELIVERY
8.1 We aim to delivery between 1-3 days on orders received by 3pm (subject to all stock being on the premises at Quench Bar & Kitchen, Burgess Hill.)
8.2 A same day local delivery service can be offered on deliveries of all wines in stock, local to Quench Bar & Kitchen, Burgess Hill.
8.3 Regional and national deliveries are carried out Monday-Friday. Some local deliveries may be available on Saturdays and Sundays.
8.4 Regional and national deliveries are normally made between the hours of 9am and 5.30pm, Monday to Friday, and a signature of someone over 18 will be required. If the person wishing to receive the delivery does not satisfy legal age requirements, including the “Challenge 25” scheme, then delivery will be refused.
8.5 For delivery to any non-mainland UK destination (including Scottish Highlands), please contact us for rates.
8.6 You can select a future working day for delivery if you wish. Please leave details in the notes to your order
8.7 Please notify us within 24 hours of delivery of any shortages or breakages by emailing askus@quenchbar.co.uk
9 RETURNS & REFUNDS
9.1 For logistical reasons, Quench Bar & Kitchen does not accept returns unless exceptional circumstances apply. In the event of exceptional circumstances, you are responsible for return shipping costs.
9.2 In the event a product has been misdescribed please email us at askus@quenchbar.co.uk and we shall resolve the issue
9.3 In the event that a refund is agreed upon, you will be refunded on the same card used for the order.
10 PAYMENT
10.1 Except for Click & Collect, you can only pay for Products using a debit card or credit card. We accept all major credit and debit cards. When you give us your credit or debit card details you are confirming that you are either the card holder, or that you have permission from the card holder to use the card to order from us.
14.2 Payment for the Products and all applicable delivery charges is in advance.
14.3 All payments are managed securely by our trusted third-party payment providers.
